Your privacy is important to Procol Tech Private Limited (“Procol or “We/we” or “Us/us”) a private limited company having its registered address at D-644, 1st floor, Saraswati Vihar, Pitampura, New Delhi -110034. This privacy statement provides information about, inter alia, what information Procol collects from the User (as defined hereinafter), including the personal information, and the ways in which Procol uses/processes, stores and discloses the information, and the choices you have with respect to the manner in which Procol shall be dealing with your information. The terms of this privacy policy (“Privacy Policy”) refers to the user or visitor (“User or “You/you” or “Your/your” or “Yourself/yourself”) of the portal of Procol named https://www.procol.io/ and the user of product or services who avails the products and services that are offered, provided, rendered and provisioned to such User from time to time as per the then policy of Procol (“Product and Services” or “Services”). Please read this Privacy Policy before using Procol Products and Services or submitting any personal information to Procol. This Privacy Policy is a part of and incorporated within, and is to be read along with, the Terms & Conditions.

  1. YOUR CONSENT
    1. By using Procol Products and Services, you agree and consent to the collection, transfer, use, storage, disclosure and sharing of your Information as described and collected by us for the limited purposes as described this Privacy Policy.

      If you sign in to the Platform through third-party sign-in services such as Google Plus or Gmail or any other social networking or similar site (collectively, "SNS"), an option of which may be provided to you by Procol at its sole discretion, you will be allowing us to pass through and receive from the SNS your log-in information and other user data;

We may receive information about you from third parties, such as other users, partners (including ad partners, analytics providers, search information providers), or our affiliated companies or if you use any of the other websites/apps we operate or the other Services we provide. When you sign in to the Platform with your SNS account, or otherwise connect to your SNS account with the Services, you consent to our collection, storage, and use, in accordance with this Privacy Policy, of the information that you make available to us through the social media interface. This could include, without limitation, any information that you have made public through your social media account, information that the social media service shares with us, or information that is disclosed during the sign-in process.     1. The Information that you share with Procol shall be entitled to privacy and shall be kept strictly confidential. The Information submitted by you shall be used for limited purpose to:
      1. administer this Platform and enhance the security of the Platform and for internal operations, including troubleshooting, data analysis, testing, research, statistical and survey purposes;
      2. personalize the Platform for you, maintain and improve our products and the Services, such as to enable deliveries and other services, enable features to personalise your user account;
      3. enable your access to and use of the Platform;
      4. publish information about you on the Platform and to understand the Users (what they do on our Services, what features they like, how they use them, etc.), improve the content and features of our Services (such as by personalizing content to your interests), process and complete your transactions, make special offers, provide customer support, process and respond to your queries;
      5. supply to you the Services that you purchase and provide you with information about such services we consider similar to those that you are already using, or have enquired about, or may interest you.     1. Procol reserves the right to make changes or modify its Platform, terms & conditions and this Privacy Policy at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and will not affect the validity and enforceability of any remaining conditions.

    2. Such Linked Sites are not under Procol's control, and Procol is not responsible for and does not endorse the content of such Linked Sites, including any information or materials contained on such Linked Sites.
    3. You will need to make your own independent judgment regarding your interaction with these Linked Sites.
    4. We urge you and/or your authorised user(s) to acquaint itself with policies of every such Linked Sites.
    5. This Privacy Policy shall not apply to any information you may disclose to any of our service providers/service personnel which we do not require you to disclose to us or any of our service providers under this Policy.
  6. REPRESENTATIONS AND WARRANTIES
    1. The User represents and warrants at all times that the User continues to use the Procol Products and Services that:
    2. the User has legal capacity under the laws of applicable jurisdictions and agrees to this Privacy Policy voluntarily, and that the User has full power, authority and capacity to comply with this Privacy Policy and the User's obligations contained herein;
    3. the User's compliance with this Privacy Policy is lawful and the User's obligations hereunder are legally binding and valid;
    4. the User has carefully and thoroughly read and understood this Privacy Policy;
    5. the User is and shall have always been compliant with this Privacy Policy;
    6. in entering into this Privacy Policy the User has not relied on any representation, warranty, statement, undertaking or conduct of any kind other than as expressly provided in this Privacy Policy;
    7. all information provided by the User is true complete, valid and not misleading in any respect.
  7. DATA SHARING AND DISCLOSURES
    1. Procol will take reasonable technical and organisational precautions to prevent the loss, misuse or alteration of your Information.
    2. We may share your information that we collect for following purposes:
      1. With Service Providers: We may share your Information with our vendors, consultants, marketing partners, research firms and other service providers or business partners, such as payment processing companies, to support our business. For example, your information may be shared with outside vendors to send you emails and messages or push notifications to your devices in relation to our Services, to help us analyse and improve the use of our Services, to process and collect payments.
      2. With Vendors/Customers: While you place a request through the Platform, your Information is provided to us and to the Vendors/Customers with whom you may choose to purchase/sell. In order to facilitate your order processing, we provide your Information to that Vendor/Customer in a similar manner as if you had placed the order requested directly with the concerned party.
      3. For Crime Prevention or Investigation: We may share your Information with governmental agencies or other companies assisting us, when we are:

      4. For Internal Use: We may share your information with any present or future member of our Group or affiliates for our internal business purposes.
      5. With Advertisers and advertising networks: We may work with third parties such as network advertisers to serve advertisements on the Platform and on third-party websites or other media (e.g., social networking platforms). These third parties may use cookies, JavaScript, web beacons (including clear GIFs), Flash LSOs and other tracking technologies to measure the effectiveness of their ads and to personalize advertising content to you.
        1. While you cannot opt out of advertising on the Platform, you may opt out of much interest-based advertising on third party sites and through third party ad networks (including DoubleClick Ad Exchange, Facebook Audience Network and Google AdSense). Opting out means that you will no longer receive personalized ads by third-party’s ad networks from which you have opted out, which is based on your browsing information across multiple sites and online services.
        2. If you delete cookies or change devices, your opt-out may no longer be effective.

  8. DATA STORAGE AND RETENTION; ACCOUNT DELETION AND DATA PURGING POLICY
    1. Procol will store the Information you provide on its secure servers. Information relating to electronic transactions entered into via this website will be protected by encryption technology.
    2. Procol shall retain your Information for as long as reasonably necessary to fulfil the purposes for which it was collected and/or for such period as may be prescribed by law from time to time.
    3. Procol shall adhere to the strict guidelines according to the law for the purging of the Information and ensure that all the Information that is collected and stored are deleted as soon as the purpose as described in the Privacy Policy is completed, unless it is mandated by law to be maintained by Procol.
    4. Any data destroyed shall be disposed of in a manner that protects the privacy of your Information, in an appropriate manner as per the industry standard practices and norms.
    5. Procol strives to purge your Information completely from our active systems and serves, residual copies may exist in our backup systems for a limited period due to technical constraints. These backups are securely maintained and will be overwritten in due course.
  9. CROSS-BORDER DATA TRANSFERS

    1. Information that Procol collects may be stored and processed in and transferred between any of the countries in which Procol operates to enable the use of the Information in accordance with this Privacy Policy. Procol shall abide by all the data protection and compliance requirements of various jurisdictions.
    2. Procol shall implement appropriate safeguards to ensure the security and privacy of Information during cross-border transfers, such as entering into Standard Contractual Clauses approved by the European Commission, utilising Binding Corporate Rules or other suitable safeguard mechanisms.
    3. We may store and manage the personal data of individuals covered by this policy on servers or databases located outside the European Economic Area (EEA). It is important to note that some of these countries might not offer the same level of data protection as found within the EEA.
    4. The data may be transferred to any country where we conduct our operations (i.e. India).
    5. To ensure the safe transfer of data outside the EEA, all our entities have entered into an Intragroup Agreement that incorporates the EU Commission's Standard Contractual Clauses. This agreement mandates that all our entities adhere to consistent technical, physical, and administrative security measures. Moreover, they are obliged to follow our data protection policies and procedures, adhere to relevant laws, and respect the terms set forth in our client and member agreements regarding data collection and usage
  10. EXERCISE OF YOUR RIGHTS

    1. You have the right to obtain rectification of any inaccurate Information and Procol shall be happy to make corrections to your Information upon such written request.
    2. Since your Information is processed, basis your consent, you have the right to withdraw your consent at any time by writing to us, and the details are mentioned paragraph 12.
    3. The Right to Restrict Processing: Under specified circumstances as listed in GDPR Regulations, you may limit the way we process your personal Information. For the purpose of this Privacy Policy, “GDPR Regulations” shall mean General Data Protection Regulation, a comprehensive data privacy legislation that came into effect on May 25, 2018, within the European Union (EU) and the European Economic Area (EEA).

Please be aware that certain essential non-promotional communications, such as account updates, transaction confirmations, product recalls, or other important notifications, will be sent to you regardless of your marketing communication preferences.
